These Terms of Service (“Terms”) govern your use of the Is It In Yet? website and service (“Service”) operated by Is It In Yet? (“we”, “us”, or “our”). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Is It In Yet? is a weather condition tracking tool for outdoor activities. It aggregates publicly available weather forecast data from third-party providers (primarily Open-Meteo) and evaluates it against user-defined conditions to indicate whether conditions at a given location are likely suitable for an activity.

The information provided by the Service is intended as a planning aid only and must not be used as the sole basis for any decision involving personal safety. Weather forecasts are inherently uncertain and may be inaccurate, incomplete, or out of date.

You hold full responsibility for making sound, educated judgements about conditions before heading out to do any activity that carries risk. Always check multiple sources, consult local knowledge, assess conditions on-site, and exercise your own judgement. Never rely solely on this Service to determine whether it is safe to undertake any outdoor activity.

We do not accept any liability for injury, loss, damage, or death arising from decisions made based on information provided by this Service.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately if you become aware of any unauthorised use of your account.

4. Free and Premium Plans

The Service offers a free tier and a paid Premium tier. The free tier is subject to limits (currently 3 saved locations and a 2-day forecast). Premium features, pricing, and limits are described on our pricing page and may change from time to time with reasonable notice.

5. Subscriptions and Payment

Premium subscriptions are billed monthly via Stripe. By subscribing you authorise us to charge the applicable fee to your chosen payment method. You may cancel your subscription at any time from the Settings page; cancellation takes effect at the end of the current billing period and you will retain Premium access until then. We do not offer refunds for partial billing periods.

6. Third-Party Data and Services

Weather data is sourced from third-party APIs including Open-Meteo and OpenStreetMap Nominatim. We do not control these services and cannot guarantee their availability, accuracy, or reliability. If a third-party provider changes, restricts, or discontinues their service, features of the Service may be affected without prior notice.

7. Accuracy and No Warranty

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that the weather data or condition evaluations will be accurate or reliable.

8. Limitation of Liability

To the fullest extent permitted by law, Is It In Yet? and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim arising from these Terms or the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or £50, whichever is greater.

9. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Scrape, crawl, or otherwise access the Service by automated means beyond normal usage
  • Interfere with or disrupt the Service or its infrastructure
  • Impersonate another person or entity

10. Modification and Termination

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We may also update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We may terminate or suspend your account at our discretion if you breach these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
